The Bank must disclose internal procedures, the Nazareth District Court ruled

The honorable Nazareth District Court ruled that the bank will be required to reveal its internal procedures during litigation that involves his client or a third party such as a guarantor.
The plaintiff was represented by the lawyers Shaul Kotler and Yonat Meyer from Shaul Kotler Law office.
Bank Hapoalim declined to reveal the internal procedures in connection with - credit granting against a mortgage, as part of a claim which was submitted against the bank. Nazareth District Court, Judge (Chief Justice) Avraham Avraham analyzed the arguments and the law on this subject, stating that there is no banking secrecy in this matter and determining that the internal procedures are relevant in the above said case. The honorable Court accepted the argument by Kotler law office that the bank unlawfully refused to reveal these documents and that it has relevance for assessing whether the bank have acted In good faith when providing the credit.

Infrastructure Company Mordechai Binyamin & Sons Earthworks (1993) Ltd. has completed a process of creditor`s settlement and restructure, in regard with debts of over 200 million NIS. The company, which have been operating since the year of 1968 and have been engaged in the operation of a quarry, road construction, earthworks, infrastructure and development, encountered difficulties in cash flow at the beginning of 2013. The company and its controlling shareholders applied to the court for stay of proceedings, and restructure. On 2.15.15 the district court in Nazareth approved the company creditors settlement including a personal settlement between the creditors and the shareholders. ADV. Kotler Shaul representing the owners: "This is a complex process, the scope of personal debt of the shareholders was estimated by Dozens of millions NIS. The result we have reached with the assistance of the Honorable Judge Eilabuni is just, economically wise, and takes into account the fair interest of all parties, which in the absence of a settlement would have collected only a minor part of the debt. "

The company found itself in bankruptcy proceedings .Tel-Aviv District Court issued a liquidation order against the company at the request of its employees. Adv. Shaul Kotler was appointed as a permanent liquidator of the company.

The Central District Court (Lod) appointed Adv. Shaul Kotler as Temporary Liquidator of O.D.F OPTRONICS LTD.
The company was engaged in development, production, assembly and marketing in Israel and abroad of an electro-optic systems and products which includes tactical surveillance and an all-directional vision for military use.
Among other things, the company generated military command and control systems, electro-optic systems, military computers, military technologies including applications for civilian use.
The company encountered severe cash flow problems following the financial difficulties which both the mother company (S.D.S Company) and the sister company (New Noga Light Company) faced with.
Adv. Kotler was authorized to seize the assets of the company and its funds.

Adv. Kotler was appointed as a Special Administrator in order to exhaust the possibilities of seizing company assets and formulizing a composition of creditors.
The shareholders of the company are Mr. Ofer Glazer, Mr. Amiram Levin, et al.

In the next few days the reorganization plan and appropriate motion shall be submitted to the court.
